The Graves-Miller Bill
Officially known as the Private Military Oversite Act, this piece of legislation changed how the United States of America dealt with the private military industry. Also, it created a new office for the executive branch: Secretary of Private Military Affairs.
First, some light should be shined on the origins of the name. The bill was written by Republican U.S. Representative Arthur T. Miller of Wisconsin. Little is known about why he wrote it, but many believe that he was coerced by the brother of the second person named on the bill. The second name refers to none other than Thomas Joseph Graves, Jr., a respectable U.S. Senator from Pennsylvania, who was an avid supporter of the bill. Even though this is the official explanation, many people believe that it refers to the Senator's twin brother, Joseph Graves, the main benefactor of the bill.
Second, what the bill does. This article of legislation allows for Private Military Corporations (PMCs) to operate on U.S. soil and abroad under the nation's banner.
Domestically, all movements must be approved by the President of the United States(POTUS) and brought to the attention of and approved by the Secretary of Private Military Oversite (SEC-OVER) before hand. Approval is not needed during local and national emergencies, when acting defensively, when contracted or hired by a municipality or entity located with in the United States, or when dealing with corporate disputes.
When working abroad, PMCs working for the United States shall operate under the nation's banner and be held to the utmost scrutiny. Also, all foreign operations must be approved by the Congressional Subcommittee on Intelligence. When acting within the territory of an allied nation, the head of state of said allied nation.
All operations are to be conducted with respect for the United States and her allies. Any and all damages to civilian property caused by the contracted PMC are to be compensated by said PMC.
Third, this bill creates a new executive office: Office of Private Military Oversite. This office is held by the Secretary of Private Military Affairs. His/her job is to pre-approve any and all PMC activities on U.S. and allied soil. The appointee for this office is to be the owner/operator of the largest PMC in the nation. Although this statement was the cause of some controversy after the bill was passed, it was approved by the mostly conservative Supreme Court, stating: "....this section allows for increased competition amongst the [PMC] industry." Also, SEC-OVER is 19th in the line of Presidential Succession, right after the Secretary of Homeland Security.
The first holder of this office was Joseph T. Graves, the owner/CEO of Global Private Security--the largest PMC in the world.
There have been several amendments made to this bill. The most significant are mentioned below.
The Teller Amendment. It is named after Republican Senator Marylin Teller of Texas, who wrote the ammendment. This article states that the appointee can be chosen from any member of the company's executive board, if the owner/operator is not willing to hold the office.
