Chapter 71

"Luisa Marion" the bailiff called.

Her parents watching as Luisa made her way to the stand, her mother wondering, was she actually going to testify against her own sister. "Why, why is she doing this" Gail asked Wayne as Luisa took the oath.

Shaking his head he merely stated, "open your eyes."

Chance felt bad for Luisa as Stein bombarded her with questions. She was a witness for the Marshall's defense though he was allowed questioning first. But he saw the determination in her eyes, she stood her ground without wavering.

"Ms.Marion isn't it true that you've always felt envious of your sister, being she is older and successful" he asked.

Holding back her laughter she answered, "No".

"Come now, be honest. You're the youngest and have always lived in the shadows of her life virtually unnoticed, isn't that true" he stated.

"Objection, your honor he's leading the witness" Porter protested.

"Damn, why are they doing this to her, she's not on trial here" Tim whispered to Chance.

"Probably trying to make it look like she's just a jealous teenager to sway everyone away from accepting her testimony as truth" he replied.

"Sustained. Mr. Stein limit your questions to the topic at hand" Judge Joyce warned.

"No further questions, your honor" Stein stated sitting down.

"What the fuck, no more questions " Jenika barked.

"Keep your voice down. No, no more questions. The seed has been planted, it will stay in their minds that she is just jealous of you, they won't believe anything she says now" he assured her.

Wayne sat behind Stein, he overheard his response to Jenika. Was it true, just jealousy of her sister or did she have more substantial proof like she'd led them to believe.

Porter stepped forward, "Ms. Marion, may I call you Luisa" he began. She advised him he could. "You and Jenika have always been close, is that correct"

"Yes" Luisa answered.

"So like most close sisters, you would share details, secrets of what was going on in your lives.  Like boyfriends, crushes, secrets, stuff you wouldn't necessarily tell anyone else, is that correct" he asked.

"Yes" she answered.

"So she must have told you about what was going on with her and her husband" Porter continued.

"Objection" Stein stated.

"Sustained..Mr. Porter may I remind you we are here for the assault on Mr. Jacob's, not the personal life of the Fousts" Judge Joyce stated.

"Yes, sorry your honor" Porter replied. "Luisa, did your sister share with you that she was coming to Wisconsin on the day of her flight" he proceeded

"No sir, she called me to pick her up at the police station at about 8 am the following morning" Luisa answered.

"The police station...did she explain why she was at the police station" he inquired.

"She just told me to pick her up and bring bail money but not to let our parents know" she answered looking at Jenika, who mouthed "bitch" to her.

"And did you do as she asked" he continued.

"Yes" she said.

"And what transpired after you arrived at the police station" he asked.

"I was led to an area where I was told to post her bail and to wait till she was released" she explained.

Porter continued to ask questions regarding the details of what she saw and was told from Jenika when she picked her up, telling him all the information just as she had provided to Chance and Tim's attorneys. Stein continued to make objections however the judge overruled in order for the details to be told. Her parents sat listening, watching both their daughters. Neither had ever given them a reason to not believe what they'd been told, at least not till now. The reactions from Jenika showed that Luisa was truthfully answering the questions leading up to when they returned home. It was all true, she lied not only to them but about Tim, their marriage and her relationship with Chance.

Judge Joyce called a recess for about an hour in order for the attorneys to prepare their closing statements. Wayne asked Stein to speak with him before going to meet with Jenika before returning to the courtroom to which he agreed.

"Ugh..is this ever going to end? She's been lieing to everyone all this time, I mean even before us. I'm sorry Timmy, I never thought she was like that" Austin told him as they washed their hands in the men's room.

"It's ok, Austin. I had no idea the full extent she was capable of until today. I feel bad for Luisa, though. That took a lot for her to testify all that about her own flesh and blood" Tim replied.

"Wonder what happens next" Austin asked.

"Hopefully we'll find out soon" Tim told him as they walked out the door.

''Listen, it's obvious she has a problem...do what you can to get to get her leniency and we'll get her the help she needs" Wayne told Stein.

"It's literally out of my hands at this point" Stein stated beginning to walk back to the courtroom.

"You have to do something,  I'm paying you to keep us both out of prison" he barked.

"Keep your damn money, your ass is staying out of jail. I'm done with both of you. She doesn't deserve any leniency after all the lives she's fucked up, including your own" he retorted slamming the door.

Everyone returned to the courtroom, now including members of the press to hear the closing statements and hopefully a verdict. Having kept it a closed courtroom for just testimony before the judge there had been no need for a jury to be present. After each attorney spoke on behalf of their clients the judge took a thirty minute recess to review the evidence in his chambers.

Everyone sat whispering amongst themselves, speculating what the judge may decide. The band's attorneys spoke with Adam informing him to look further into the financial records back to when they released Pierce and hired her, for any misappropriation of funds by her.

"Great, that's all he needs. All because of me. I should never have let her in, never" Tim thought to himself listening to the conversation around him.

Chance noticed the tension in Tim's body, he knew he was blaming himself. Holding back from taking him in his arms he leaned over, "it's not your fault,  not now, not ever" he whispered. Olena sat behind them, she saw the look on Chance face "Thank God he has him in his life" she thought as Tim seemed to relax a bit by the sound of his voice.

The bailiff escorted Jenika back into the courtroom. Obviously angered she stared at everyone who had spoken against her, that is everyone but Chance. She actually smiled at him, a smile that gave him chills, and not in a good way.

The bailiff called for all to stand as Judge Joyce returned. Once seated he began...." I have reviewed all the information provided during these proceedings...the video, the transcripts, the documents provided to the attorneys prior to today's hearing....Ms. Marion you initially were charged for assaulting a Federal Marshall, a class D felony, for which you posted bail and were released. However, you failed to return for the court sentencing for the initial charge which resulted in the issuance of the warrant for your arrest. While attempting to execute this warrant you once again assaulted the same Federal Marshal, Mr. Jacobs. Such actions on your part have now resulted in an additional assault charge adding a  class C felony due to causing a more serious injury. Young lady,  you are now facing a minimum of twenty five years in prison. What do you have to say for yourself"

Jenika stood, face reddened, fake tears rolling down her cheeks, " Your honor, these are all lies. I didn't do any of the things I've been accused of " she stated now walking in front of the judge begging for sympathy.  "The only thing I'm guilty of his loving that man right there " she confessed having spun around, now facing Chance. "Tell them, Chance..tell them how much we love each other" she begged.

Everyone watched as she moved closer grabbing him and kissing him hard. But, he didn't respond..he never moved, never returned the kiss.  As she stepped  back he took his hand and wiped off his lips. The bailiff quickly stepped behind her now pulling her back as she began to scream at him, at everyone for what they'd done to her.

"Order, order in the court" Judge Joyce barked slamming the gavel. The bailiff was assisted by another court officer as they restrained Jenika with cuffs and shackles. Constantly screaming for Chance to help her she was finally escorted out of the courtroom. Her mother cried hysterically at the spectacle before her, her father yelled to her to calm down as they slammed the door.

"Order,  Order" the judge bellowed. "Sit down, all of you" he demanded as the courtroom finally came to order.

"Mr. Porter, Mr. Stein...The final judgment for this case is Ms. Jenika Mae Marion is sentenced to twenty five years in the Wisconsin state penitentiary for the Class C Felony charge against Mr. Jacobs".

Jenikas mother continued to cry out, her father requested leniency for her citing her emotional state for what she'd been through.

The Judge looked at her father,  "Mr. Marion, you are correct her emotional state is of great concern which is why she will be placed in the mental ward of the prison where she will receive counseling for her delusional behavior, however she will not be eligible for parole and is sentenced to an additional  twenty five years based on these findings. These sentences will be served consecutively, a total of fifty years in prison" he stated, slamming the gavel "This court is now adjourned".
